Privacy Rules

The operator of the BUDFITTER s.r.o. e-shop on the website www.budfitter.com, with ID number 24846694 and registered office at Krmelínská 631, 739 23 Stará Ves nad Ondřejnicí, processes personal data provided by Buyers for the purpose of fulfilling and confirming the Terms and Conditions, processing electronic orders, delivering goods, settling payments, and necessary communication between the contracting parties for the period required by special legal regulations.

Basic Provisions

1. The controller of personal data pursuant to Section 5 letter o) of Act No. 18/2018 on the Protection of Personal Data, as amended (hereinafter referred to as the “Act”), is CARETTA SPA CZ s.r.o., with ID number 24727237 and registered office at Krmelínská 631, 739 23 Stará Ves nad Ondřejnicí (hereinafter referred to as the “Controller”);

3.Personal data means all information identifying a natural or legal person.

Sources of Processed Personal Data

1.The controller processes personal data provided by the buyer with consent and obtained by the controller based on the performance of the Purchase Agreement and processing of electronic orders in the online store www.budfitter.com;

2.The controller processes only the identification and contact details of the buyer necessary for the performance of the Purchase Agreement;

3.The controller processes personal data for the purpose of delivery, payment settlement, and necessary communication between the contracting parties for the period required by special legal regulations. Personal data will not be disclosed, and there will be no transfer to other countries.

Purpose of Processing Personal Data

1.The controller processes the buyer’s personal data for the following reasons:

2.For the purpose of registration on the website www.budfitter.com pursuant to Section 13 paragraph 1 letter a) of Act No. 18/2018 on the Protection of Personal Data;

3.For the purpose of processing the electronic order of the buyer (name, address, email, telephone number);

4.For the purpose of fulfilling the rights and obligations arising from the contractual relationship between the buyer and the Controller;

5.Providing personal data is a necessary requirement for the performance of the purchase contract. Without providing personal data, the contract cannot be concluded.

Retention Period of Personal Data

1.The controller retains personal data for the time necessary to perform the rights and obligations arising from the contractual relationship between the buyer and the Controller and for 3 years after the termination of the contractual relationship;

2.After the expiration of the retention period of personal data, the Controller is obliged to delete the data.

Recipients and Processors of Personal Data

1.The third party receiving the buyer’s personal data is the Controller’s subcontractors. The services of these subcontractors are essential for the successful performance of the purchase contract and electronic order between the controller and the buyer.

Buyer’s Rights

According to the conditions set forth in the Act, the buyer has the right to:

1.Access their personal data;

2.Correct personal data;

3.Delete personal data;

4.Object to processing;

5.Data portability;

6.Withdraw consent to the processing of personal data in writing or electronically to the email address: office@caretta-spa.cz;

7.File a complaint with the Office for Personal Data Protection if they believe that their right to the protection of personal data has been violated.

Security of Personal Data

1.The controller declares that they have taken all appropriate technical and organizational measures necessary to secure the buyer’s personal data;

2.The controller has taken technical measures to secure the data storage of personal data, especially securing access to the computer with a password, using antivirus software, and regular maintenance of computers.

Final Provisions

1.By submitting an electronic order on the website www.budfitter.com, the buyer confirms that they have been acquainted with the terms of personal data protection and accepts them in their entirety;

2.The buyer agrees to these rules by checking the checkbox in the order;

3.The Controller is entitled to change these Rules at any time. The Controller is obliged to publish the new version of the Rules on their website.

These Rules come into effect on 29.11.2021.
